Starting out from a position of ignorance, it'd be reasonable for her to be angry and want to sue, but then have someone who knows what's what explain the facts of life to her.

However it happened, I do hope she learned something out of all this.

AngieAngiehttps://www.blogger.com/profile/11920578701763415331noreply@blogger.comtag:blogger.com,1999:blog-1847902007209931042.post-23029224737178560242012-04-21T20:38:00.754-07:002012-04-21T20:38:00.754-07:00Ms. Smith might have contacted an attorney. After ...Ms. Smith might have contacted an attorney. After reading the contract, the attorney excused herself, went the ladies' room and laughed hysterically for the next five minutes. Then the attoreny went back to her office and explained in a calm, reasonable manner what Ms. Smith's problem was and how much it would cost Ms. Smith to file a lawsuit. The attorney never heard from Ms. Smith again.

(Not that this EVER happened while I was practicing law.)Suzan Hardenhttps://www.blogger.com/profile/04600258874634909988noreply@blogger.comtag:blogger.com,1999:blog-1847902007209931042.post-39000989829817308892012-04-21T08:17:27.482-07:002012-04-21T08:17:27.482-07:00Charles -- I hadn't thought of that possibilit...Charles -- I hadn't thought of that possibility. I suppose it's possible. [ponder] Even if it's possible to break a contract on the "But I didn't know what that meant!" defense (and I don't think it is) she'll only get there by making herself look incredibly stupid. Maybe she thinks that's worth it, if she thinks she has a ghost of a chance of getting "her" series back? I don't know, I wouldn't bet on that scenario.

It's been a year or so since that post went up, though. You'd think that if there were legal action taken, there'd be some info about it by now. I Googled around and didn't find anything.

I think Ms. Smith just screwed up and was looking for some sympathy from her fans. I don't see how she couldn't understand what work for hire was if is she'd been around at all. And the contract would have spelled it out. She's just making herself look rather silly here.Charles Gramlichhttps://www.blogger.com/profile/02052592247572253641noreply@blogger.com
